OK I’m totally confued as to why is EJ sueing John?????

IIRC, an attorney does not need to know each and every plaintiff on a personal level either; he simply files the lawsuit and posts notices in newspapers, on TV, or through any means of advertising available, notifying anyone who has lost their money, pensions, or profit shares, in other words, life savings, to notify the attorney (E.J.) thereby joining the class-action suit as a party-plaintiff. Boy, this is one trial I can’t wait to get started. Even the Salem P.D. were victims, and most likely will be party to the suit as a corporate entity. What I don’t see happening is E.J. being the prosecuting attorney if he is elected mayor. Guess we’ll have to wait and see, but this is going to be exciting to watch. Can’t wait!

October 7, 2011 at 10:34 pm #27269DeeLanParticipantI’ve gotten notices of class action suits with companies I’ve done business with in the past and to be a part of it I don’t have to do anything. If I want to file a claim on my own then that removes me from the class action suit.
October 8, 2011 at 10:11 am #27284BonbonParticipantYou are automatically a member of any class action suite UNLESS you opt out of it, which entails signing lots of forms. Probably the only reason you would want to opt out would be if you wanted to pursue legal action on your own, maybe thinking you will make out better than being a party to the class action. Or, probably less likely, if you did not agree with the suit.
But, like Patti said, it would still be widely published, not to include people but to give them the option of opting out. They must be informed that they can do that. Companies are required by law to provide the attorney names and addresses of everybody who could possibly be included in a class action.
October 8, 2011 at 12:56 pm #27290DeeLanParticipantRight, and doesn’t it take more than a few hours to get a class action suit written up correctly and filed. Of all the ones I’ve been part of I’ve notten nothing except a couple of shares in Kodak. All the other ones gave me nothing. There’s one going on now that I was first notified over 5 years ago and I just got another post card the other day telling where they’re at in the process.
October 8, 2011 at 1:43 pm #27294BonbonParticipantsuit against Dow-Corning for the silicone breast implants (of which I had two) they made. This was only for reconstructive surgery, not augmentation. It was claimed they were giving women all kinds of life-threatening problems. Then, after billions of dollars were paid out and Dow-Corning filed for bankruptcy, it was discovered the implants were not at fault after all. A good example of the legal system gone awry.
I also got $200 from the suit against the drug Fen-Phen, even though I had no ill effects from taking it. It was punative damages.

I have been waiting for John to return…and (as much as I love the "badness" of the DeMera’s because they do it so well)…I want John to come back and open a can of WHOOP-A_ _ on them – payback for all the little DeMera things they’ve done to every one in Salem over the years…and my John is just the one to do it (along with Bo, Roman, Rafe, and even Jack’s help – and the ladies of Salem too)!

October 9, 2011 at 12:58 am #27332PattiParticipantI have a friend who joined a class-action lawsuit, and for the life of me I can’t remember who or what the defendant was, but her check came in the mail ……. now wait for it ……. for $12.23.
October 9, 2011 at 12:31 pm #27350BonbonParticipantI got a real tiny one too (can’t remember how much but under $10) from an alledged fraudulant investment in one of the stocks in a mutual fund I owned. I didn’t know anything about it until I got I got the check. (Don’t know why I hadn’t received previous notification.)

All of the other stuff that takes years has not taken place yet. I am thinking this one is not going to trial and will be cleared up when John is not convicted and whoever stole the money has to pay it back. So we won’t see the five year process.
